It has been claimed that litigation and complaints to external investigative agencies (such as state and territory ombudsmen) against universities by disgruntled students are on the rise, particularly in a climate where higher education is now seen as more of a commercial enterprise. This project investigated why and how conflicts between students and universities arise and, in some cases, escalate into external complaints or litigation. The authors reviewed relevant literature and cases to identify trends; surveyed and interviewed university students and staff across fourteen Australian universities; interviewed student advocates from sixteen student associations and three others external to the university sector to gain their perspectives about how universities handle student complaints and disciplinary matters. They also reviewed the complaints and appeals processes of all Australian universities to test their accessibility and compliance with regulatory regimes. A national conference on student grievance and discipline in Australian universities was also held. Common themes that emerged included: lengthy complex processes for resolving complaints and appeals; students reluctance to risk academic progress by complaining; student difficulty in obtaining information about how to raise concerns or lodge appeals; lack of perceived objectivity of campus ombudsmen; inadequate training of university staff on how to deal with complaints or appeals; inconsistency in the way universities capture data about complaints and appeals; irreparable damage to student's relationship with his or her university; mixed response to suggestion of national student ombudsman.
